Terms of Service

1. Platform Purpose

SurveyConnectHub is a digital marketplace that connects clients seeking surveying, geomatics, GIS, mapping, land, engineering, and related professional services with independent service providers.

SurveyConnectHub facilitates introductions, job postings, communications, escrow payment workflows, and related marketplace tools. Unless expressly stated otherwise, SurveyConnectHub is not the direct provider of services listed by independent providers.

2. Eligibility

• be at least 18 years old
• have legal capacity to enter binding agreements
• provide accurate registration information
• comply with applicable laws

We may refuse access at our discretion where legally permitted.

3. Account Registration

• Clients
• Service Providers
• Business Accounts
• Other approved account types

You are responsible for:

• maintaining confidentiality of login credentials
• all activity under your account
• promptly notifying us of unauthorized access

We may require identity verification, licensing proof, business documents, or other compliance information.

4. User Representations

• all information submitted is accurate
• licenses/certifications claimed are valid where required
• you will not impersonate others
• you will use the Platform lawfully and professionally

5. Marketplace Relationship

Clients engage providers directly. Unless expressly agreed otherwise:

• providers are independent contractors, not employees of SurveyConnectHub
• SurveyConnectHub does not supervise field work execution
• users are responsible for evaluating suitability before engagement

We may provide ratings, reviews, badges, verification indicators, or recommendations, but these do not constitute guarantees.

6. Job Postings and Service Listings

Clients may post projects, requests, or opportunities. Providers may create profiles and respond to opportunities.

Users must not post:

• false or misleading opportunities
• unlawful projects
• discriminatory content
• abusive, fraudulent, or deceptive material
• content infringing third-party rights

We may edit, reject, suspend, or remove listings at our discretion.

7. Escrow Payments

SurveyConnectHub may offer escrow or payment holding services directly or through third-party partners.

General Escrow Process

1. Client funds are deposited into escrow.
2. Funds are held pending milestone completion or project completion.
3. Funds are released according to agreed milestones, approvals, dispute outcomes, or these Terms.

Important Terms

• Release timing may vary due to reviews, banking delays, compliance checks, or disputes.
• We may require identity verification before payouts.
• Fraud prevention holds may apply.
• Payment processor terms may also apply.

8. Fees and Commissions

SurveyConnectHub may charge:

• client service fees
• provider success fees
• subscription fees
• listing promotion fees
• payment processing pass-through costs
• other disclosed charges

Fees may change with notice where legally required. Users authorize deduction of applicable fees from transactions where relevant.

9. Cancellations, Refunds, and Disputes

Where disputes arise, users should first attempt good-faith resolution.

SurveyConnectHub may, but is not obligated to:

• review communications and project evidence
• mediate disputes
• determine escrow releases in accordance with available evidence
• issue partial refunds where appropriate

Our dispute decisions may consider fairness, documentation, milestones, communications, and policy compliance.

10. Provider Obligations

• perform services professionally and lawfully
• meet reasonable deadlines where accepted
• maintain required licenses/insurance where applicable
• communicate honestly
• avoid off-platform fee evasion where prohibited

11. Client Obligations

• provide accurate scope details
• cooperate reasonably with project execution
• fund escrow when required
• review deliverables promptly
• avoid abusive or fraudulent conduct

12. Prohibited Activities

• commit fraud or scams
• scrape or misuse platform data
• harass others
• upload malware
• bypass fees through bad-faith circumvention
• violate sanctions/export laws
• infringe intellectual property rights
• manipulate reviews or ratings

13. Intellectual Property

The Platform, branding, software, logos, text, and systems belong to SurveyConnectHub or its licensors. Users retain rights in materials they upload, but grant us a license to host, display, process, and use such content for operating the Platform. Project deliverable ownership between client and provider depends on their agreement unless otherwise stated.

14. Privacy

Your use of the Platform is also governed by our Privacy Policy.

15. Third-Party Services

The Platform may integrate third-party services including:

• payment processors
• identity verification tools
• analytics providers
• communications services

We are not responsible for independent third-party services beyond applicable law.

16. Disclaimers

The Platform is provided on an "as available" and "as is" basis to the maximum extent permitted by law.

We do not guarantee:

• uninterrupted availability
• project outcomes
• provider quality in every case
• client payment absent funded escrow
• error-free operation

17. Limitation of Liability

To the maximum extent permitted by law, SurveyConnectHub shall not be liable for indirect, incidental, consequential, lost profit, or punitive damages arising from Platform use. Our aggregate liability shall not exceed the greater of fees paid to us in the preceding 12 months relating to the claim or the minimum amount required by law.

18. Indemnity

You agree to indemnify and hold harmless SurveyConnectHub from claims arising from your breach of these Terms, your unlawful conduct, your projects, services, or deliverables, or infringement of third-party rights.

19. Suspension and Termination

We may suspend, restrict, or terminate accounts for:

• policy breaches
• fraud risk
• non-payment
• abusive conduct
• legal/regulatory reasons
• prolonged inactivity

20. Governing Law

These Terms shall be governed by the laws of Tanzania, unless mandatory laws of another jurisdiction apply. Disputes may be submitted to competent courts or lawful dispute forums in Tanzania, subject to applicable law.

21. Changes to Terms

We may update these Terms periodically. Updated versions become effective when posted unless otherwise required by law. Continued use after changes may constitute acceptance.
